Work
The work outlined in this agreement will be carried out in a first class manner and to your reasonable satisfaction
We will not commence work before receiving an acceptance form signed by client indicating acceptance of our terms and estimate(s).
Acceptance of our terms indicates the clients permission for employees of Loam Gardens, their consultants, sub contractors and suppliers to enter the clients property to carry out the work to be undertaken.
We are to supply all the necessary labour, machinery, transport and materials (unless otherwise stated) to carry out the work to be undertaken.
We do not offer any warranty that work will not be subject to difficulties arising from boundary problems, third party rights or any other matters relating to town and country planning, about which you must make your own enquires.
Payment
All Materials plants and drawings remain the property of Loam Gardens until paid for in full.
Payment will be required in full on completion by cheque or bank transfer, information for both can be found at the bottom of invoice.
We reserve the right to charge a minimum administration/late payment fee of £30 per week to accounts where payment is not received within 7 days of invoice.
Where stage payments have been agreed in advance with client, we reserve the right to not to undertake a succeeding stage until funds have been cleared for previous stage(s).
A non returnable deposit of one third of the estimate total is required with orders in excess of £1000.
The outstanding amount will be required in full on completion by cheque or bank transfer unless otherwise advised.
Any Estimate(s) provided is valid for a period of 30 days. Any verbal estimate is not valid unless it is subsequently provided in writing.
As far as possible, prices will remain the same as on the original estimate, if however, a supplier is unable to supply the item(s) and we have to source it from elsewhere, we reserve the right to alter the estimate. If we cannot source the item from elsewhere, we reserve the right to substitute with similar item, within reason, which may alter the estimate. We will endeavour to contact the client first, but referral is not always possible.
Unless otherwise specified in writing, appropriate charges may be made for the disposal of debris from clients gardens.
Only the work specified in our estimate is included in the price(s) shown. Unless specifically stated no allowance is made for extra work. Any additional work and or materials, including plants requested by the client and not part of the estimate will be charged for as ‘extras’.
Estimates
Responsibility
We do not accept responsibility for the welfare of any animals or children. We strongly recommend that animals and children are kept indoors whilst work is undertaken due to the use of ladders, electrical, chemical and machinery involve.
This time should be extended to at least 2 hours following our visit where spraying in involved. (All spraying work undertaken is in accordance with the guidelines as laid down by the FEPA.
We do not accept responsibility, during work for any difficulties arising from damage caused to hidden or underground cables, pipes or other services or obstructions, unless the precise location and depth have been advised by client in writing and verified by ourselves prior to commencement of any work.
Any additional work, materials and expenses required to overcome such problems will be charged for as ‘extras’ to any estimate.
We do not replace plants supplied by us, which subsequently die due to neglect or natural causes.
Mulching requires regular application to remain effective to restrict weed growth and retain moisture within the soil.
e are unable to guarantee that any pruning undertaken by us will be sufficient to eliminate wind rock damage being caused by severe weather.
